but what if your child died because they couldnt get the transplant they needed in time... because an illegal immigrant was moved to the top of the list.. :shrug:
Sold my 95 RS "Little Peanut" but she will never be forgotten. :(

so lets sue the hospital, so that way the cost of medical insurance will go up and even more people wont be able to afford it, causing thousands of other children to die because their parents cant afford insurance any more.<p>but at least jessicas family will have lots of money.<p>but hey its your country, do what you want. like they say no good deed shall go un-punished.<p>
If that happend here, the guy that messed up would be fired and the hospital would apologise and set up a bank account for the family, then the news would ask for donations for the family, that way the family would be compensated a reasonable ammout. <p>why sue them? it wont stop mistakes from being made, to think that is just stupid, people will always make mistakes, that is part of being human.

i really dont understand why...someone was killed due to the ignorance of the people in charge and because she was illegal she doesnt deserve the same rights that anyone else would get? andno you shouldnt feel sad for me because when i was younger i had someone close to me die due to negligance due to the hospital so i know what it feels like to be able to do nothing.

I'm in the us, half legally and half illagal, as a student at one university just because I dropped a couple of classes and did not maintain the status of full-time student. Damn, I still go to school. It's not that fun to be a stranger in the us sometimes even though America, as a wealthy country, can give us so many opportunities. Foreigners may not be paying as much tax as the typical citizens probably because they usually don't own much like the land or house. I pay some for tax and even pay a little more at the tax return. We usually pay more, like 3 times more for tution at school.<p>I'm fortunate that I'm from japan and my country is as good as us or canada. But the countries around japan, like korea or thai, it's totally a diffenrent story. They can live in their countries forever, but they will have the better life if they come to the us.

About the lawsuit, I'm not really sure if the way to solve problem, millions of dollars to them, may not be right. As you guys suggested, donations to other people who can't afford, would be nice. I know there are tons of people struggling every day, and they might be the ones in need of help. It's interesting and good to know that some mx3 junky, inlcuding me, care such poor little girl and care about her. :) I wish her family can get over this unfortunate mistake.<p>bungo

In the US its not the thought that counts, its the action and I can't think of a clearer case of medical malpractice. It would be different if this doctor was working for free, but he is getting paid the big bucks and is expected to perform his services perfecty. It would be like if you took your MX-3 in for an oil change and they ended up destroying your engine, would you just walk away and say "its cool, they didn't mean to" Hell no! You would be pissed and demand that they pay for a new engine, after all they are professionals and should know what they are doing. <p>Unfortuantely the hospital can't give these people a new daughter but they can make an attempt at compensation by paying resonable compensation for the forfeit of Jessica's life. What amounts to reasonable compensation is ultimetly up to the jury if it even goes that far, 90% of civil lawsuits are settled out of court. To assume that the family is going to receive millions upon millions of dollars is not fair. If hospitals and doctors never have to answer for the mistakes they make what incentive do they have to improve? The hospital and doctor should be punished for this mistake, maybe it will force them to implement more stringent control methods for checking the blood types of organs so that people won't die from this in the future.
