sohc idle problem

I was going to buy one of those breather filters but a guy at automotive place said that u can get a $900 fine for having one is this true. The reason he said was that it pollutes or something but I don't see how it does. Please could somebody respond because my car has the same problem when I come to a stop at a light when it idles I have a 5 spd. I also fine when u push on the brake it tends to shake more. Thanks Iam a new member Iam not a girl I just used the name because it is my wifes idea.
