If you car look modified and goes missing in Montreal ......

Post by Yoda »

If your car looks modified and goes missing in Montreal It hasn't been stolen. It has probably been impounded by the MUC police. Yes the police have been taking parked cars off the street because they looked "Modified" eg: lowered, plus size mags, mufflers, wings, tints and impounding them until they can be inspected. Some offices are have stock cars impounded because they think it looks modified. One car being a 100% stock VW Jetta with the optional 18's that was just driven off the lot the day before. The officer said it looked lowered and the wheels are to big. An Older gentlemen in his 50's had his new Maxima impounded because he argued with the officer that it is the factory tinted glass and there was no tint film that could be removed. Both cars pasted inspection after being impounded and it was realized that both cars were 100% stock. There was a stock new Tiburon that at first the officer argued the exhaust wasn't stock because it has dual tips. Then he proceeded to insert a tape measure into the tip when he past a certain measure he tried to say that this was proof the muffler wasn't stock but on a Tiburon the muffler is in the middle of the car. The officer was claiming this was and test for "modified emissions" equipment. The officer also tried to have the owner start the car and move it onto the street since it was on private property. At this point the officer was asked step off this person property unless he justify a "real" reason for his presences to be there. I have a few fiends with other police dept or are no longer on patrol duty they know of no actual laws in the books these officers are enforcing. Judging from another even that I was a witness to a sgt. / shift supervisor admitted that all the partol officers have been ordered by higher ranking officers (that him) to "look for" (harass) "modified sport/ compact car owners and ticket them as much as possible". If that isn't profiling I don't know what is. By the sounds of it there are a couple class action law suit directed at certain officers by name. There are also indications that city polce force as a whole is under review both internally and by an external police force. BTW the dept of transport were running training seminars to educate all the police forces what is illegal, and what is acceptable When it came to Montreal senior command for the Montreal police force refused to have their officers educated so instead have their officers making up the laws as they go along because they don't even know what the actual law refers to in the first place and even worst don't even know were some of the parts they are ticketing are located on the car. They are mostly counting on that most of the tickets are issued to younger kids that don't know better so will not fight them in court and with just pay the fines.

Around here (Cali) you can have your car crushed if you are caught street racing, but seeing as how that is breaking the law (in more ways than one) and you are being caught red handed I can see how it is justified.

Towing cars they think aren't stock is ridiculous. It's harassment. It's hard, time consuming, and painful to get your car back from an impound lot. Having to go through that if you aren't guilty is unacceptable.

Seems like everything is turning into a witch hunt these days.

Apparently they're trying to pass a bill that a car can be seized to be used for street racing, and it can get towed and crushed, so the officer is judge, jury and executioner and you have no way to get the vehicle back. Even if the car is on your propery, all they need to assume is that the car is being used for street racing they can take it away, It's kinda stupid. I really need to post and send some info about it but I've been too busy. Deimos knows more info about it since I haven't been back in Canada for a few months.

Apparently in Ontario we have a new law that states that the authorities can crush your car if its modded. They say

"If we suspect you have performance mods done to your vehicle obviously for the purpose of street racing we can take the vehicle and crush it and you will never see it again. We can take it out of your driveway"

Well my mx3 is sitting in my driveway and it has alot of mods and I race it on a track alot. If I wake up or come home from work and my car is gone I will seriously f---ing flip. I will steal one of the freakin cop cars from the station and see how they like it..muahahahah

Unless it was after 11:00 PM or before 7:00 AM there is no law in Quebec or MTL bylaw that the cop could ticket you for. Ever then St. Catherines is noises place at least until 3:30 4:00AM when the clubs close.

With the media coverage of the new Ontario Laws this week. I talked to a few people that were pulled over by cops in MTL who tried to ticket them with the new law announced in the news and have there car impounded for doing more that 50km over the limit. The cop was pissed when this person called 911 and had a police supervisor get on the line and explain to the cop that it was an Ontario law and not a Quebec law. Seems that this offices saw it on the news before his shift was thought it was a new local law as well.

in rockford IL someone can call the cops and claim you played loud music and they will come impound your car without any actual proof and can hold it for up to 45 days (not sure of the number) while waiting for a hearing and then charge you around a grand for impound fees.

that's right no actual proof is needed, so if you don't like someone living in rockford here is your ticket to revenge

Here in Victoria, OZ, the only reason they can seize a car is if you're checked doing more than 45kph over any limit or doing some 'circle work'. As for unreasonable noise, the officer has to witness the noise and deem it to be unreasonable for a person to be charged. They are first given a directive to reduce the noise which lasts for twelve hours. If they don't they get fined. There are no annual roadworthy or smog tests here but random roadworthy checks are conducted by police who have the power to stop you and check your car. They don't have to fine you, they can 'defect' the car and require you to fix any faults. This gives them alot of power, but they only seem to use it if they get complaints about some knucklehead racing around the 'burbs. Cheers.
Craig from OZ.

see those all make sense speeding 45k over is bad if you get caught well too bad... and all of those require proof and the cop seeing what happened not just hearsay

I think its insane to have a law like that. I would try to sue the state or something. They cant just assume that because your car is modified your going to street race.

If your caught racing... well nothing you can do there. But just because your car is modified they shouldnt be able to do anything.

Thats like making a law stating that no car on the road can have more then 250hp stock or modified. That will never happen.

If anything, isnt this going to encourage people to start buying WRXs and other cars that come with performance modifications?

Some modificatins like lowering your car 3inches or having all windows tinted to 5% to 0%. I could understand, but the others are just BS
