His Name is David.
He was selling a BP from his Protege a few months ago for $150.
We agreed on $150 for the engine & other stuff +$150 for shipping.
I fedex'd him the check on 12-29-03 for $300. He cashed it.
It is now 3 months later & Still no engine.
I have had lots of empty promises though. I have heard : "I am shipping it this Friday, I promise" over 4 times now.
He says that he has had a problem finding a shipping co, & that he finally found one & has paid them, but he needs to take the engine & other stuff to them, and they are 3 hours away.
Getting a bit frustrating, & starting to sound a bit fishy, ya know??
Chris (mx3tt) bought his transmission from him and gave him a good report, so I trusted that this transaction would be just as smooth.
Well it has been anything but smooth.

I just got an email from him saying that it was shipped, but included no shipping company name, Estimated time of arrival, or tracking info....

Well It was supposedly shipped on 3-28-04-- but he cannot come up with a tracking number of any sorts.
I called AAA Cooper (the shipping compnay he told me) and they have no record of any shipments from David Diaz to Perry Bennett or to Carl Black (where its being shipped)
They did confirm that they use tracking numbers though.
I emailed him to find out the tracking number 2 times-- one he did not even read, he just deleted.
It is over a week later and I still have no Engine.
So, I emailed him again today and threatened to call my lawyer if he cannot show proof that it was actually shipped.
I have his address & can get a copy of my cancelled check. This shouldnt be to hard to win should it go that far.
I will keep you updated.

Hey man, Call your attorney, at least have him contact the guy. It might cost you a little bit, but if its what it takes to gets him moving then do it. Also, make sure you have copies of all emails you have sent to him, with dates and times. And a copy of the check with transaction info from the bank. If youre going to nail his a**, nail it hard. Im no lawyer, but i am a licensed private investigator, and i hate to see stuff like this. Send him one more email saying that he has 24 hours to respond before you take legal action. See if he doesnt get back to you.

I got an email from Dave today...
Apparently he had a family emergency and left the engine for his friend to ship. Thats why h did note reply to my emails. He apologized for it not being done and said that he and his uncle will take it Wednesday.
Also, he said that he will have AAA Cooper call me once its shipped for confirmation.
We will see....

Wednesday has come and gone. No Phone call/e-mail from Dave or AAA Cooper.
Just sent him an email that if I dont get a confirmation that he has sent it by Thursday Night, I will do a follow-up call with Miami-Dade County Police on Friday.
Giving him the benefit of the doubt one last time...

A little update--
Dave still has the engine, He is calling AAA Cooper for them to pick it up & he said he would cover any extra charges.
He says he wants to get rid of the engine-- but has just had a very hard time getting the thing shipped.
He promises to be working on it and will keep me updated.
So, we'll see....

Well Apparently Dave & I had a miscommunication.
He gets paid THIS Friday and has promised to have AAA Cooper come pick it up either Friday, Over the weekend, or Monday.
Hell, I dont know.

Time for another update...
Still no F*cking engine.
Since May 4th, He has twice more promised to ship the engine. He said that he took May 11th off so he could wait for AAA Cooper to come pick it up and said he had already paid for everything-- they just needed to pick it up.
Tuesday Passes-- no email or call with a tracking number.
He emails me and says that AAA Cooper will not pick it up because he has paid a company called Glory Freight to ship it-- and although they work with AAA Cooper-- their items cannot be picked up by them.
He also tells me that his dad has already rented a U-Haul truck for May 14th and he will take it to the shipping yard himself on May 14th. (He also chooses to tell me that now he does not have the BP ECU that was part of the deal, he apparently sold it already.. whatever)
Friday Passes, no emails or anything.
The past two emails I have sent to Dave have not been answered. According to AOL, he has not even read them yet. That was from 5-18.
I emailed Dave's Girlfriend (or someone who says she is, anyway) on 5-19 and she said that he is going thru some tough times and he will eventually ship it, just to give him another week and a half.
The Detective that is supposedly working on my case in Miami will not return my calls.
I have had no contact with that F*cker since May 4th and he will not return my emails.
So I am still sitting here-- with no engine.
I may have a lead on a phone number for his house that I sent the check to... should I call it??
