What should I do about my girl's citation

I've always been a big fan of going home and looking on the computer to see what the actual ordinance or law is that I have broken when charged. Well, my girlfriend got a ticket for expired registration (didn't change address when we moved and didn't get renewal slip because of this....) So she's screwed there. However, here is the situation surrounding the ticket.

She was in a public parking lot at the local Marina, they were closed but there is no sign posed stating no trespassing on shore, and she wasn't charged with that. Cop drove into the parking lot, left the ticket on her car, and drove out. She never knew he was there until she got back to her car. She has been charged with Violation of Section 10.60.175 (B) and nothing else. Here's a link: http://www.ci.sparks.nv.us/municode/Tit ... 0/175.html

In 10.60.175, it says nothing of the legality of having a vehicle parked in a public parking lot with an expired registration.

I think the law she broke doesn't apply to her because she is in a parking lot, and the law she broke doesn't appear to have and control of a parking lot. What do you guys think?

I have been told by many cops that you should ALWAYS fight your tickets.. even if you are 100% guilty.. sometimes the cops dont even bother filing their copy of the ticket with the state.. you show up for court.. the court has no record of it.. it gets thrown out (I had this happen in one instance to me personally) Worst case scenario.. the judge will usually lower the fine. As for giving the judge the finger.. wait till the judge aint lookin ;)

interesting situation. The parking lot she was parked in is owned by the city?

I'd take it to court. You'll probably get the fine lowered. You're lucky that the cop didnt give her a ticket and waited in the area to give her a ticket. I'm sure its more of a fine if you actually drive the car. They may class the parking lot as an alley thought you may get away with it.

all right most states have laws saying all cars must have a registration, except, new & used cars


also this is what i think, does the ticket carry points yes/fight it


no pay the ticket................


i went to court for registration not being forward & the judge told me it was my job & not the state to registar my car, thats why the tags, have those dates on it

Here, that's a fix-it ticket. Get DMV to sign it off when you get your registration cleared, and send $10 to correct it.

I'd say pay the fine, learn the lesson and move on. Don't waste time and resources on it.

After all the car was unregistered and had to 1) get there and 2) be taken away. Everyone knows it must have been driven on the road, even the judge. If I was the judge I'd see you fighting it as a waste of his time. Yes he may have to go through the motions but the outcome will probably be the same. And you'll have wasted all your time and worry.

How much was the fine?

I've go t outta tons of tickets that way. As far as parking tickets go, I throw em' in the nearest waste basket and pretend they never happened! Wouldn't reccomend that, though. With my luck it'll catch up to me someday :oops:

its just weird because they all say that if you do not pay them they'll suspend your registration until payed. But so far nothing, its been 2 years and 2 cars since I got the last one(only done this about 5 times) Weird! :?

The way they do it around here is if you have outstanding fines against you they wont let you renew your plates. If you dont pay it they'll add that amount onto the price of the registration renewal and they'll pay the fines through that.

Well, incase anyone cares what happened with the whole situation, here's an update.

I think she could fight it and win. But she doesn't want to spend the energy... she'd rather spend the $170 to make it go away. Her friends she was with that night are going to all chip in and pay it for her so I guess that's cool. These are the same friends that she says make her happier than I do, same friends that she will probably end up leaving me for... yeah.... good trade. 4 years relationship vs her old coworkers who "I didn't think they would wanna hang out with me after I walked out a month ago."

Sorry guys... just a bit bitter right now and needed a loving environment to vent on.
