There is a seal between the two pieces of glass under the spoiler and I wouldn't trust it to be completely water proof. Have a lawyer write a letter and see what happens. If still nothing then go to the police, or ask for thier insurance companies name and their policy number, then call their insurance company. The insurance company will most likely tell you the same thing untill you have a lawyer write a letter, then it is cheaper for them to just pay you instead of having a law suit.
